1.0 Integrated Family Delivered Neonatal Care mobile application

This document sets out the terms governing your use of the Integrated Family Delivered Neonatal Care (IFDC) mobile application (App). This mobile application was developed by Imperial Neonatal Services (Imperial College NHS Healthcare Trust, London) and was funded by the Imperial Health Charity.

These terms and conditions apply to all users of the App. In using the App you confirm that you have read and understood the information herein.

The App is composed of two main components: an Educational component and a Diary function (with optional cloud storage).

We provide educational material about neonatal care for non-commercial, information purposes only.

2.0 How the Trust handle your personal information. 2.1 Personal Information Collected and Safety:

Personal data refers to any identifiable information about you, such as your name, e-mail address. In order to register and benefit from the services of the App you are required to provide us with personal information including your or your Baby’s name, your e-mail address, and the date of birth and gestational age of your Baby. This is the only identifiable information retained by the Trust during your use of the App.

Imperial College Healthcare NHS Trust is defined as a data controller under current European data protection legislation and is consequently required to implement appropriate technical and organisational measures to protect personal information. Your personal identifiable information will only be used for registration purposes. It will not be shared with, or sold to, anyone else and will be handled in accordance with all applicable legislation.

Your personal information will be automatically encrypted prior to transfer, after transfer it will be stored using secure and encrypted protocols by ‘Digital Ocean Inc.’ whose servers are located in London, UK. Propeller Ltd will have access to the encrypted database for the purposes of resolving errors and application management.

2.2 How long we will store your information

Your personal information, including any back-ups or caches, will be automatically deleted from our secure database when you stop using the App for over 1 month or delete the App from your device.

2.3 Information sharing

We will only share your information for the purposes of providing the App to you and will only share the minimum information required for these purposes. We will keep your information confidential except where disclosure is required or permitted by law (for example to government bodies and law enforcement agencies).

2.4 Information gathered from your use of our Mobile Apps (analytics)

When you use our mobile apps we may collect certain statistical information automatically, such as about mobile device you are using and information about your use of our apps. Where possible, unique identifiers are anonymised and at no time do we attempt to identify you as an individual. This App does not collect precise real-time location information about your device. Automatically gathered information is used to enable us to provide you with a better service by helping us to understand how our mobile apps are used and by reporting any technical problems to us (anonymously).

3.0 Your responsibilities 3.1 Securing your devices

It is your responsibility to keep your devices secure; this includes keeping your log-in credentials safe and secure.

Should you feel your password has been compromised you can reset it any time via the link at the home page of the App. To keep your personal data secure, we recommend resetting your password regularly in every 4-6 weeks.

3.2 Using the personal diary functions

You are responsible for the security and content of the information uploaded to the diary function. The App offers the possibility to store data on cloud-based services, this enables you to synchronise your personal diary on different devices using the same login details. The user assumes responsibility for the security of all devices connected to their individual account.

If you do choose to use a third-party cloud based storage provider then please be aware of their policies in relation to privacy and cookies. As the end-user you determine the purposes and means of processing this subset of information and are responsible for its management.

3.3 Privacy in the Neonatal Unit

Photos, videos or any electronic material of members of staff or infants of other parents should not be uploaded to your diary without their prior consent of the subjects. Any behaviour to the contrary will be deemed as an infringement of privacy for which you can be prosecuted.

3.4 Internet connection and Updates

Certain functions of the App will require an active Internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but we cannot take responsibility for the App not working at full functionality if you do not have access to Wi-Fi, and you do not have any of your data allowance left. Along the same lines, our team cannot take responsibility for any data loss or if you use the App for inappropriate purposes.

The app is currently available on Android and iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the App to) may change. We suggest that you update the App regularly to ensure the continuity of the service provided.

3.5 Copyright

We are offering you this App to use for your own personal use without cost, but you should be aware that you cannot send it on to anyone else, and you’re not allowed to copy, or modify the App, any part of the App, or our trademarks in any way. You are not allowed to attempt to extract the source code of the App, and you also should not try to translate the App into other languages, or make derivative versions. The App itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, still belong to Imperial Neonatal Services (Imperial College NHS Healthcare Trust, London) and Imperial Health Charity.

3.6 Users under 16 years of age

If you are under 16 years of age, you must have your parent/guardian’s permission before you download the app and provide us with any personal information for registration of the app.

4.0 Our responsibilities

Our team is committed to ensuring that the App is as useful and efficient as possible. For that reason, we reserve the right to make changes to the App, at any time and for any reason.

We will make reasonable effort to keep the information within the App up to date; however we cannot promise that the information always will include the most recent findings or developments.

If you have not followed these terms and our Privacy Statement we may consider to immediately, temporarily or permanently take away your right to use the App. We may also wish to stop providing the App, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the App, and (if needed) delete it from your device. On termination or deletion of App from your device/ cloud storage, your registration information held by the App developer team will be destroyed completely.

5.0 Cookies

Cookies are small text files, which are set by a website or app operator so that your browser or device may be recognised. They typically contain anonymous information such as a unique, randomly generated ID. We may use cookies in our mobile App to provide certain functionality to you, such as push notifications.
